In January 2024 the Construction Industries Division approved the adoption of the 2021 NM Energy Codes. The separate NM Residential Energy Code and NM Commercial Building Code are approved for phase-in from January 30, 2024 through July 30, 2024. Permits during this period may be issued to either the 2018 Energy Codes or the 2021 Energy Codes. As of Tuesday, July 30, 2024 all permits must be issued compliant with the 2021 Energy Codes.

January 14, 2023 the Construction Industries Commission approved the adoption of the 2021 Building Codes. The Phase-in of the new codes began January 14, 2023, and effective July 14, 2023 permits were required to comply with the following Building Codes:

As of March 25, 2021, these 2018 NM Energy Codes (Residential & Commercial) became the mandatory minimum statewide. Check your municipality to see if they have adopted more stringent requirements

These codes were in effect starting November 15, 2017, but through June 30, 2017 contractors could have received building permits that comply with either the 2009 or 2015 codes. As of July 1, 2017, only these 2015 codes were in effect.
